Gold Party Host

As recipient of the Gold Party Pack and organizer of the Gold Party (hereinafter “Gold Party Host”), you agree to be responsible for not only your own Unwanted Gold Items, defined herein as items thought to be gold or platinum and placed inside the Mini Gold Party Packs supplied by Gold Party Canada, but the Unwanted Gold Items belonging to your Gold Party Guests, defined herein as the people who attend your Gold Party and choose to sell their Unwanted Gold Items to Gold Party Canada using the Gold Party Pack service. You further agree to hold Gold Party Canada harmless in the event that any or all of the aforementioned Unwanted Gold Items become missing or lost while in your possession.

You agree to be responsible for shipping your own Unwanted Gold Items, as well as the Unwanted Gold Items belonging to your Gold Party Guests, with FedEx and in the manner set forth by Gold Party Canada in the Gold Party Pack.

In circumstances where Gold Party Canada sends payment in the form of a personal cheque to you or your Gold Party Guests for your Unwanted Gold Items, you agree to be responsible for receiving and distributing these cheques in a timely manner to your Gold Party Guests without incident and to hold Gold Party Canada harmless in the event that any or all of the aforementioned cheques become missing or lost while in your possession.

In circumstances where Gold Party Canada sends (a) Non-Gold Items, defined herein as items found by Gold Party Canada in its sole discretion to not be authentic gold or platinum, (b) Returned Unwanted Gold Items, defined herein as items found by Gold Party Canada in its sole discretion to be authentic gold or platinum but that the Gold Party Host or Gold Party Guest(s) elect(s) not to sell, or (c) Valuable Diamonds, defined herein as diamonds determined by Gold Party Canada in its sole discretion to have inherent value, you agree to be responsible for receiving and distributing all of the aforementioned items to your Gold Party Guests in a timely manner without incident and to hold Gold Party Canada harmless in the event that any or all of the aforementioned items become missing or lost while in your possession.

Gold Party Guest, Gold Party Host

As Gold Party Host and/or Gold Party Guest, you certify that you are at least 18 years of age and are the legal owner of the Unwanted Gold Items you wish to sell to Gold Party Canada. Gold Party Canada reserves the right, but is not required or obligated, to request the necessary documentation certifying the aforementioned, as well as proof of compliance with the Terms And Conditions stated herein.

Gold Party Canada in its sole discretion will determine the value of your Unwanted Gold Items using the same appraisal techniques as it does at all of its Gold Party events. Similarly, Gold Party Canada in its sole discretion will determine the value of the stones in your Unwanted Gold Items, making every reasonable effort to remove and return Valuable Diamonds, but not removing, returning or paying for semi-precious stones, cubic zirconium or non-valuable diamonds (i.e. pave diamonds, melee diamonds, diamond chips, etc.).

Gold Party Canada assumes no liability and you agree to hold Gold Party Canada harmless in the event that any or all of your Unwanted Gold Items become missing or lost while in your possession or in the possession of your Gold Party Host.

Gold Party Canada will guarantee against loss of a shipment up to five hundred dollars ($500) if shipped with FedEx and in the manner set forth in the Gold Party Pack. If the contents of a shipment exceed five hundred dollars ($500), Gold Party Canada assumes no further liability. Any reimbursement of a lost shipment will only be issued after a FedEx claim is settled. Gold Party Canada assumes no liability and you agree to hold Gold Party Canada harmless in the event that you or your Gold Party Host fail to ship your Unwanted Gold Items with FedEx and in the manner set forth in the Gold Party Pack.

Gold Party Canada reserves the right to reject delivery of any shipment which appears to be opened, damaged or tampered with, at which point the shipment will be rerouted or delivered back to you or your Gold Party Host. Gold Party Canada assumes no liability for any such attempted delivery or the return of any such items.

In circumstances where Gold Party Canada sends (a) payment for your Unwanted Gold Items in the form of a cheque, (b) Non-Gold Items, (c) Returned Unwanted Gold Items or (D) Valuable Diamonds to your Gold Party Host on your behalf, Gold Party Canada assumes no liability and you agree to hold Gold Party Canada harmless in the event that your Gold Party Host fails to distribute any or all of the aforementioned items in a timely manner or at all on account of loss, theft, neglect or for any reason whatsoever.

Gold Party Canada shall not be liable for damages. This includes, but is not limited to, consequential, incidental, punitive and loss of opportunity or profit. By sending your Unwanted Gold Items to Gold Party Canada, you accept this limitation of liability.

By shipping your Unwanted Gold Items to Gold Party Canada, you are agreeing to all terms and conditions stated herein.

Upon written or verbal acceptance of the offer to purchase your Unwanted Gold Items by Gold Party Canada, the offer is deemed to be accepted and the sale of such Unwanted Gold Items is final.
